If you’re considering buying or selling a lakefront property in New Hampshire, it’s important to be aware of a recent regulatory change that could impact your transaction. Up until September 1, 2023, sellers of lakefront properties within 200 feet of the high-water mark were required to hire a licensed engineer to conduct a site assessment.
This report had to be presented to any potential buyers, who then had the option of performing their own septic inspection. It was an additional step in the process that often led to delays and complications.
As of September 1, the New Hampshire Department of Environmental Services (DES) has changed the rules. Sellers are no longer required to conduct a site assessment. Instead, the responsibility has shifted to buyers. If you’re buying a lakefront property, you are now mandated to have a septic inspection done by a licensed septic inspector.
One key point to remember is that if any issues are found with the septic system during the inspection, it must be replaced within 180 days. This all needs to be completed before the closing, which means both parties may need to negotiate repairs or replacements before the transaction can proceed.
This change simplifies the process for sellers but adds a new layer of responsibility for buyers. It ensures that any septic issues are addressed early on, potentially saving both sides from future complications.
